Terms of Service

1. Acceptance of Terms
By accessing or using HomiApp ("the Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of the terms, you may not access the Service.
Your continued use of the Service after posted or notified changes may constitute acceptance of those changes. For material changes, Homi may request new in-app acceptance before you continue using the Service or affected feature.
2. Description of Service
HomiApp is a Progressive Web App (PWA) Software as a Service (SaaS) platform designed for appliance repair businesses and independent technicians in the United States. The Service allows you to manage:
- Appointment and job scheduling
- Customer management
- Invoice and quote generation
- Team and technician tracking
- Routes and job locations
- Live team location, only with consent and an eligible plan
HomiApp is a software tool. HomiApp does not perform repairs, dispatch technicians, guarantee jobs or customers, process end-customer payments, or act as an employer, insurer, accountant, tax advisor, attorney, legal agent, or customer fiduciary.
3. Registration and Accounts
To use the Service, you must create an account by providing a valid email address and password. Authentication is managed through Firebase Authentication.
You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
One account corresponds to one business. The business administrator is responsible for managing permissions, members, roles, data, location, exports, account closures, and labor or commercial compliance within their organization.
4. Plans, free launch, and future billing
HomiApp is free during launch and does not require a credit card to create an account.
During launch, promotional limits, evolving features, and reasonable availability changes may apply.
Subscription prices are not published during this stage. If HomiApp activates billing in the future, we will notify the company administrator at least 60 days in advance and show plans, pricing, effective date, and consequences of not choosing a plan.
Before operational blocking for not choosing a plan, we will try to provide a reasonable window to select a plan or export data. When billing exists, additional terms may cover taxes, renewals, downgrades, suspension, read-only periods, export, and refunds.
Homi does not take a commission per job and does not act as merchant of record for payments you receive from end customers.
5. Acceptable Use
By using the Service, you agree NOT to:
- Use the Service for illegal or unauthorized purposes
- Send spam, unsolicited messages, or abusive content through the Service
- Attempt to access data from other businesses or users
- Resell, sublicense, or redistribute the Service without authorization
- Interfere with the operation of the Service or its servers
- Reverse engineer, decompile, or disassemble any part of the Service
- Upload malicious content, viruses, or harmful code
- Upload data you do not have the right to process
- Use Homi for robocalls, robotexts, unauthorized telemarketing, or communications that violate applicable laws
Violation of these rules may result in suspension or termination of your account.
6. Intellectual Property
Our software: HomiApp, including its source code, design, logos, trademarks, and documentation, is the exclusive property of HomiApp. You do not acquire any ownership rights over the software by subscribing to the Service.
Your data: You or your company retain rights to the data you enter into the Service, including customer information, jobs, invoices, and other content you create. HomiApp receives a limited license to host, process, display, protect, back up, transmit, and provide the Service.
You must not upload content that infringes third-party rights. Homi may restrict or remove content affected by a reasonable intellectual-property claim while reviewing the situation.
7. Privacy
The use of your personal data is governed by our Privacy Policy, which is an integral part of these Terms of Service.
For Customer Data uploaded by a user business, the business determines the purposes and means of processing, and Homi processes that data to provide the Service. Homi acts independently for account, security, support, legal records, terms acceptance, and Homi billing data when billing exists.
8. GPS Tracking and Location Privacy
Live location is available only for field users (administrators or technicians), with an eligible plan, configured working hours, and specific separate consent. HomiApp is designed to show current location, not route history.
- The user must accept the location notice before location is transmitted.
- Location is shared only during an active session and within working hours configured by the business.
- Outside working hours, when the app closes, when consent is revoked, when plan access is lost, or when the user is suspended, live location is cleared.
- Location is visible only to the user's business and is not sold, shared with external third parties, or used for advertising or profiling.
If a business enables location for its team, that business administrator is responsible for complying with applicable labor laws, monitoring notices, internal policies, and state requirements.
9. Document Generation and Fiscal Responsibility
HomiApp enables businesses to generate commercial documents (diagnostics, quotes, and invoices) as part of their operations. Regarding the use of this feature:
- Software tool, not a fiscal advisor. HomiApp is a software tool. It does not act as an accountant, tax consultant, legal agent, or customer fiduciary. We do not review, validate, or approve the content of the documents you generate.
- Content responsibility. The user business is solely responsible for the content, fiscal accuracy, legal validity, and consequences of the documents it generates using HomiApp. This includes — without limitation — names, amounts, descriptions, tax identifiers, and any information contained in the final document.
- Tax calculation. HomiApp does not calculate or withhold taxes automatically. If the business chooses to itemize taxes on its invoices, it does so at its own discretion, entering the amounts manually and assuming full responsibility for their calculation, reporting, and payment to the corresponding authorities.
- Record retention. HomiApp retains issued PDFs and minimum fiscal metadata for a conservative 7-year period, subject to legal hold. Other data, such as support, drafts, logs, or location, may have shorter periods under the Privacy Policy.
- Post-send immutability. Documents issued and sent to the end customer are immutable. Corrections are made by issuing new documents (credit note or corrective invoice) that reference the original — not by editing or deleting the originals.
10. Support, attachments, and sensitive data
If you send reports, screenshots, photos, videos, or files to Homi support, you must limit the content to what is needed to resolve the case. Do not send SSNs, identity documents, full payment card numbers, banking data, passwords, medical data, children data, or highly sensitive material unless strictly necessary and no safer alternative exists.
Attachments may be visible to the Homi team and essential storage, email, or support providers. WhatsApp and email may have their own provider controls and retention.
11. Security and providers
Homi uses reasonable controls such as authentication, company-level rules, companyId isolation, encryption in transit, permission validation, and controlled storage. Our underlying infrastructure uses providers such as Firebase/Google Cloud. Provider certifications should not be read as Homi's own certifications.
If we detect a security incident requiring notice, we will act without undue delay and according to applicable law, our contractual commitments, and the nature of the incident.
12. Limitation of Liability
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied.
HomiApp shall not be liable for:
- Data loss due to circumstances beyond our control
- Temporary Service interruptions due to maintenance or updates
- Indirect, incidental, special, or consequential damages arising from the use of the Service
- Loss of revenue or profits related to the use or inability to use the Service
To the maximum extent permitted by law, HomiApp's total liability for any claim is limited to the greater of: (a) amounts paid or payable by your company to Homi for the Service during the 12 months before the claim, or (b) a reasonable nominal amount while the Service is in free launch, unless applicable law requires otherwise.
You agree to defend and hold Homi harmless from claims by customers, employees, contractors, authorities, or third parties arising from your work, documents, taxes, communications, use of Customer Data, team, or violation of these Terms.
13. Termination of Service
You may cancel your subscription at any time. Upon cancellation:
- Your access will continue until the end of the current billing period
- There may be an operational or read-only window to export data
- Some fiscal, legal, security, or acceptance records may be retained privately under the Privacy Policy
HomiApp reserves the right to suspend or terminate your account if:
- You violate these Terms of Service
- You fail to make the corresponding payments
- You use the Service in a way that harms other users or the Service itself
14. Electronic notices and changes to Terms
You agree to receive legal, operational, and account notices electronically, including email, banners, in-app modals, or messages inside the Platform. You may request help accessing electronic records by contacting support.
HomiApp reserves the right to modify these Terms of Service at any time. Changes will take effect upon being posted on this page.
For significant changes, such as billing, new data uses, location, AI, liability limits, or legal forum, we will provide clear notice and may require new acceptance before you continue using the Service or affected feature.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law provisions.
Before starting a formal action, the parties will try to resolve the dispute in writing for at least 30 days. Any dispute related to these Terms shall be resolved in the competent courts of the State of Florida, unless applicable law requires another forum.
